I just watched “House” on TV the other night and House tried to fire Foreman for not breaking up with his girlfriend when he told him too. I posted about this online and I said this was illegal unless there was a written non-fraternization policy and to my surprise many people are lambs who think that anyone can fire them without cause. I’m not talking about company lay-offs to groups of people, I’m talking about unfair dismissal individual firings. Bottom line, if you ever get fired without cause, get an employment lawyer and you’ll probably win because basically you’re not allowed to get fired without cause. Don’t let them pull an Unfair dismissal no no on you.

Fired without cause basically means that there is no company written rule for the reason you were fired and that you were not given adequate written warnings, etc. In short, an employer can not just individually fire you without giving you a reason and the reason better be in a written company rule and directive and followed exactly as written. As I said usually that means you are to get written warnings as well.

Here are a couple of examples of some scenarios where you should consult with an employment lawyer:

1. Your boss without any prior notice in writing just goes to you, I don’t like your work, your fired. No can do.

2. You get in an argument with your boss but its not witnessed by anyone and your boss fired you for insubordination. Well unless you admit to it, it won’t stick.

3. Your boss doesn’t like the way you look or dress or your religion or the person your dating or your politics, etc. They can’t legally fire you for this.

4. You won’t go out with the boss. He can’t fire you for this

The bottom line is if your boss wants to fire you they can but it has to be well documented and they just can’t go up to you and say you’re fired get out.
