If Marshall University and University of Houston Receiver Patrick Edwards Settle Out of Court Hopefully the NCAA Will Butt Out
This Blog is purely speculation on my part, but I’m guessing Marshall University and University of Houston Wide Receiver Patrick Edwards will eventually settle amicably out of court as it would be the common sense thing to do and hopefully the NCAA will do the right thing for once and not interfere.
Patrick Edwards is the talented redshirt freshman Wide Receiver for Houston who was leading the Cougars in receiving yards (634) and was third in receptions (46). He is also the Cougars’ primary kickoff return specialist, averaging 20.2 yards on 25 returns. Last Saturday, he suffered a compound fracture of his right leg after running into an equipment cart that was parked just off the playing field at Marshall’s Joan C. Edwards Stadium, where carts had absolutely no business being parked on there for player safety. Click here to see what happened. Its the second play on this Hi Def Clip

Normally, a player in an NCAA football game can not as far as I know sue for injuries obtained as that is considered part of the game for which the players health coverage will be paid for by insurance I’m guessing from their College or the NCAA but in this case there’s an obvious case of Negligence because Patrick Edwards clearly wouldn’t have suffered his injury otherwise nor did he have any reasonable expectation of being injured by a cart. Apparently, the carts have been there for 2 years or so and somehow by the grace of God no one was injured in the past. Marshall has now removed them from that area.
Edwards interesting enough doesn’t blame Marshall but holds the officials responsible for not removing the carts before the game began. “They are supposed to check and see if everything is off the field,” Edwards said.
Marshall University has done the right thing by taking responsibility and appologizing to Edwards, paying his Medical Costs and having the Head Football Coach and some of the teams players visit Edwards in the Hospital. At this point there is speculation that Edwards mother may file a lawsuit.
I’m totally guessing that Marshall University will contact the Edwards family or Vice Versa and a settlement will be amicably worked out. I hope if that happens the NCAA doesn’t pull one of their typical actions which make no sense and interfere with the process. Obviously I’m not a fan of the NCAA but that’s another blog, but think of it, basketball players at Arizona State who went to school there to play for Lute Olsen, basically wasted 2 years of their lives not being able to transfer immediately and 3 years if they decide to transfer now.
